OFFICIAL RULES
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED BY LAW. BY PARTICIPATING IN THE SWEEPSTAKES, ENTRANT AGREES TO BE BOUND BY THESE OFFICIAL RULES AND THE DECISIONS OF THE SPONSOR, WHICH SHALL BE FINAL AND BINDING IN ALL RESPECTS. ALL DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION AND ENTRANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT.
1. ELIGIBILITY: The Sweepstakes is open only to legal U.S. residents residing in one (1) of the fifty (50) United States or the District of Columbia who are eighteen (18) years of age or older (nineteen (19) or older if a resident of Alabama or Nebraska) with a valid US driver’s license or government issued photo ID at the time of entry. The following persons are not eligible to participate: employees, contractors, directors, and officers of Frito-Lay, Inc. (“Sponsor”), Genesco Sports Enterprises, Inc. (“Administrator”), and each of their respective parent, subsidiary and affiliated companies, distributors, Web design, advertising, fulfillment, judging and promotion agencies involved in the administration, development, fulfillment and execution of this Sweepstakes (collectively, “Promotion Parties”), and the immediate family members (spouse, parent, child, sibling, grandparent, and/or “step”) of each and those living in their same households (those persons whether related or not who live in the same residence for at least three (3) months during the twelve-month period preceding the start date of the Sweepstakes).
2. SWEEPSTAKES PERIOD: The Sweepstakes begins on September 30, 2024 at 12:00:00 p.m. Eastern Time (“ET”) and ends on November 8, 2024 at 11:59:59 p.m. ET (“Sweepstakes Period”). The time clock of the computer administering this Sweepstakes is the official time-keeping device of the Sweepstakes.
3. HOW TO ENTER: During the Sweepstakes Period, visit TeamUpWithTostitos.com (“Website”) or scan the code on a Sweepstakes display to access the Website. Choose “Ohio State” (represented by their football team’s logo), “Louisiana State University” (represented by their football team’s logo), or “College Football” (represented by a picture of a football) (each a “Group”) to register for the Sweepstakes and take a quiz. The quiz will contain questions relevant to the Group you chose. Upon completing and submitting the answers to the quiz, you will receive one (1) entry into the random drawing corresponding to the prize pool assigned to the Group for which you selected. Answers to the quiz do not need to be correct to count as an entry. You will obtain an entry once the quiz is completed and submitted, regardless of your answers.
Limit three (3) entries per person/email address per day per Group. A “day” is defined as the twenty-four (24) hours between 12:00:00 a.m. ET and 11:59:59 p.m. ET of the same day except the first day of the Sweepstakes Period which shall begin at 12:00:00 p.m. ET and end at 11:59:59 p.m. ET of the same day.
To scan the code found on displays advertising the Sweepstakes, entrant must have a smart phone or other web-enabled device with a camera feature or code reader application and may incur data charges from their wireless service provider for each use of the code, depending on their service plan. An entrant cannot participate solely by scanning the code. Check with your wireless service provider for details on these and any other applicable charges. Entrants are solely responsible for any such wireless or data charges associated with such use, including the downloading (if applicable) and use of the code reader. If you do not have a code reader on your phone or device, search for one in your mobile device’s application store to find available code readers for your phone or device. code readers may not be available on all devices. Mobile entry is not required to submit an entry or win a prize in this Sweepstakes.
All entrants must have a valid email address. Multiple entrants may not share the same email address. A potential winner may be required to provide identification sufficient to show that he or she is the authorized account holder of such account. Each entry must be manually key stroked and/or manually entered by the individual entrant. Automated and/or repetitive electronic submission of entries (including but not limited to entries made using any script, macro, bot or sweepstakes service) will be disqualified and transmissions from these or related email addresses or IP addresses may be blocked. If it is discovered that an entrant used multiple email addresses, phone numbers and/or mailing addresses or manipulated such information for the purpose of obtaining more than the allowed number of entries or prizes as stated herein, that person will be disqualified and any prize won shall be forfeited.
In the event of an identity dispute of an entrant, the entry will be considered made by the authorized account holder of the email account the entry is submitted from at the time of entry. The “authorized account holder” is the person who is assigned to the email account by the online service provider. If such dispute cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible. Those who do not follow all of the instructions, provide the required information in their entry form, or abide by these Official Rules or other instructions of Sponsor may be disqualified. All entrants submitting materials/content/comments as part of the Sweepstakes will be non-exclusively licensing (with the unlimited right to sublicense) to Sponsor and Promotion Parties the right to use such materials, and the images related thereto (including entrant’s name, social media account username and likeness), for any purpose (including any and all commercial purposes) with the right to modify the materials and make derivative works thereof. Entries submitted by entrants who do not meet the eligibility requirements (including all requirements with respect to age and residence) are void.
4. RANDOM DRAWING: For each Group, one (1) potential winner will be selected in a random drawing on or about November 11, 2024 from among all eligible entries received for that Group. All drawings will be conducted by the Administrator, whose decisions are final. Odds of winning depend on the number of eligible entries received per Group. Limit one (1) prize per person/household.
5. PRIZE DETAILS:
“Ohio State” Prize (1): Trip for winner and winner’s one (1) guest to attend the Ohio State vs. Michigan game scheduled to take place on November 30, 2024 in Columbus, Ohio (the “Game”). Travel dates: November 29, 2024 – December 1, 2024. The trip consists of round-trip coach air transportation for winner and winner’s one (1) guest (from a major airport near winner’s home); double-occupancy, standard hotel accommodations for two (2) nights; two (2) tickets to the Game; and $500.00 (awarded in the form of a check, payable to winner). “Louisiana State University” Prize (1): Trip for winner and winner’s one (1) guest to attend the Oklahoma vs Louisiana State University game scheduled to take place on November 30, 2024 in Baton Rouge, Louisiana (also the “Game”). Travel dates: November 29, 2024 – December 1, 2024. The trip consists of round-trip coach air transportation for winner and winner’s one (1) guest (from a major airport near winner’s home); double- occupancy, standard hotel accommodations for two (2) nights; two (2) tickets to the Game; and $500.00 (awarded in the form of a check, payable to winner). “College Football” Prize (1): Trip for winner and winner’s one (1) guest to attend winner’s choice of one of these games: LSU vs. Oklahoma on November 30, 2024 (in Baton Rouge, Louisiana) or the Ohio State vs. Michigan game on November 30, 2024 (in Columbus, Ohio) (winner’s choice of game shall hereinafter also be referred to as the “Game”). Travel dates: November 29, 2024 – December 1, 2024. The trip consists of round-trip coach air transportation for winner and winner’s one (1) guest (from a major airport near winner’s home); double- occupancy, standard hotel accommodations for two (2) nights; two (2) tickets to the Game; and $500.00 (awarded in the form of a check, payable to winner). Prize Conditions: Ground transportation (other than as stated above), parking, upgrades, meals, gratuities, souvenirs, luggage fees, and all other expenses not specified herein are solely the winner’s responsibility. A minor child may accompany winner as a guest only if minor’s parent or legal guardian is the winner. Minor must be accompanied at all times during all prize-related events by minor’s parent or legal guardian. Once the guest is selected, they may not be substituted, except in Sponsor's sole and absolute discretion. The guest (or their parent or legal guardian if guest is a minor) must complete and return a Liability/Travel Release prior to Sponsor’s designated travel agency making travel arrangements. All travel and prize-related events are subject to availability, change and restrictions. Winner will be required to provide a credit card prior to hotel check-in and is solely responsible for all incidental charges and may be required to sign an additional liability release for the use of the accommodations. Selection of hotel, airport(s), airline(s) and seating on flights are at Sponsor’s sole discretion. If a winner resides within two hundred fifty (250) miles of the destination city, the Sponsor will award $200.00 (payable to winner in the form of a check) in lieu of air transportation. Sponsor assumes no responsibility for canceled, delayed, suspended or rescheduled prize- related events (including, but not limited to airline flights) or any act or omissions whatsoever by the air carriers, hotels, venue operators, transportation companies, prize providers or any other persons providing any prize- related services or accommodations beyond its control. Sponsor is not responsible for changes in schedule of any element of the prize or for any expenses incurred as a consequence of flight cancellation or delay. Airline tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles. All airline tickets are subject to flight variation, work stoppages, and schedule or route changes. Winner and guest must travel on the same itinerary. Winner and guest must have all necessary identification and/or travel documents (e.g., a valid U.S. government issued ID, Real ID or passport) required for travel within the United States. Sponsor is not responsible and will have no liability if the winner and/or their guest is, for any reason, not permitted to travel by the relevant airport authorities or misses a flight or other travel element or redeem any other prize element. Sponsor reserves the right to terminate the prize at any time and send winner and their guest home immediately if winner and/or their guest engages in behavior that is illegal or is non-sportsmanlike or disruptive, or with intent to annoy, abuse, threaten or harass any other person at any time during the trip. Winner understands that there are inherent risks involved in travel and that these risks may be present before, during and after the trip.
Game is subject to availability, change, and/or cancellation. Sponsor assumes no responsibility for a canceled, delayed, suspended or rescheduled Game. No alternative date will be provided. Prize may be subject to additional terms and conditions, including but not limited to terms regarding Game rescheduling or cancellation. Winner will not receive compensation from Sponsor in the event of game delay, postponement, or cancellation. If winner cannot attend the Game on the date specified, prize shall be forfeited and Sponsor shall have no further obligation to such individual. Tickets are only valid for the date shown on the ticket. Seating assignments are in Sponsor’s sole discretion. Winner and their guest may be required to produce government-issued identification prior to entering the Game. Sponsor is not liable for any missed events or opportunities or expenses incurred as a consequence of any transportation delay or in the event winner and/or a guest is late to the Game (through no fault of Sponsor or due to Force Majeure Event). Resale of Game tickets is strictly prohibited. Any such resale or commercial or promotional use may result in disqualification and prize forfeiture. Winner and guest must abide by all venue policies and regulations, including without limitation all health and safety protocols, and ticket terms and conditions at all times. Ticket redemption may require a mobile ticketing app and is subject to terms and conditions as stated thereon and provided via such mobile ticketing platform. Winner may be required to provide a valid email address, download the applicable mobile ticketing app to their mobile device, and present tickets at stadium via mobile device. Data rates may apply. Winner is solely responsible for any such wireless or data charges associated with such use, including the downloading and use of mobile ticket app. WiFi is provided at the stadium. The Sponsor reserves the right to revoke the full or partial prize from any winner or guest who the Sponsor or venue personnel deem in any of their sole discretion, may be intoxicated, be a safety risk, have violated any venue policy or law, fail to comply with the venue’s health and safety protocols, or bring Sponsor into disrepute. For the avoidance of doubt, unused tickets cannot be refunded, exchanged or applied towards tickets for any subsequent game or for cash.
Winner and guest fully understand that (a) the novel coronavirus SARS-CoV-2 and any resulting disease (together with any mutation, adaptation or variation thereof, “COVID-19”) is extremely contagious and there is an inherent risk of exposure to COVID-19 in any place where people are or have been present; (b) no precautions, including any protocols that will be implemented from time to time by Sponsor or other governing authorities, can eliminate the risk of exposure to COVID-19; (c) while people of all ages and health conditions have been adversely affected by COVID-19, certain people have been identified by public health authorities as having greater risk based on age and/or underlying medical conditions; and (d) exposure to COVID-19 can result in being subject to quarantine requirements, illness, disability, other short-term and long-term health effects, and/or death, regardless of age or health condition.
6. WINNER NOTIFICATION: The potential winners will be contacted by the Administrator via email within two (2) business days of the drawing and will be required to follow instructions within the notification within forty-eight (48) hours (beginning at the time the notification was sent), or prize may be forfeited, in Sponsor’s sole discretion. The potential winners will also be required to complete, sign and return an IRS Form W-9 (including their social security number) and an Affidavit of Eligibility/Liability Release with (where lawful) a publicity release within forty-eight (48) hours (beginning at the time the Affidavit was emailed). Failure to return the required documents within the allotted time may result in prize forfeiture and the awarding of the prize to an alternate winner. Sponsor and Promotion Parties are not responsible for suspended or discontinued Internet or wireless service or a change in a winner’s email address, which may result in a potential winner not receiving a prize notification. If any prize notification or prize is returned as undeliverable, if a potential winner does not respond to the notification (as instructed within the notification), if a potential winner cannot be verified or is otherwise unable to accept the prize as stated, prize may be forfeited and awarded to an alternate winner, in Sponsor’s sole discretion. Sponsor and Promotion Parties are not responsible for any undelivered emails, including without limitation, emails that are not received because of a winner’s privacy or spam filter settings which may divert any Sweepstakes email, including any winner notification email, to a spam or junk folder. Upon forfeiture of the prize for any reason, no compensation will be given.
7. LIMITATIONS OF LIABILITY AND RELEASE: No liability or responsibility is assumed by Sponsor or Promotion Parties resulting from entrant's participation in or attempt to participate in the Sweepstakes or ability or inability to upload or download any information in connection with the Sweepstakes. No responsibility or liability is assumed by the Sponsor or Promotion Parties for technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the Sweepstakes: Hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online or network communication problems; errors or limitations of any Internet or wireless service providers, servers, hosts or other providers; garbled, jumbled or faulty data transmissions; failure of any online transmissions to be sent or received; lost, late, delayed or intercepted transmissions; inaccessibility of the Website in whole or in part for any reason; traffic congestion on the Internet or the Website; unauthorized human or non-human intervention of the operation of the Sweepstakes, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, or worms; or destruction of any aspect of the Sweepstakes, or loss, miscount, misdirection, inaccessibility or unavailability of the Website or an entrant’s email account used in connection with the Sweepstakes. The Sponsor and Promotion Parties are not responsible for any printing, typographical, technical, computer, network or human error which may occur in the administration of the Sweepstakes, the submission of entries, the announcement of the prizes, or these Official Rules, or any inaccurate or incorrect data contained on the Website. Use of Website is at user’s own risk. Sponsor and Promotion Parties are not responsible for any personal injury or property damage or losses of any kind which may be sustained to user's or any other person's computer or web-enabled device resulting from participation in the Sweepstakes. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL, CONSEQUENTIAL, OR OTHER DAMAGES; AS A RESULT, THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU, AND THE FOREGOING PARAGRAPHS SHALL NOT APPLY TO A RESIDENT OF NEW JERSEY TO THE EXTENT DAMAGES TO SUCH NEW JERSEY RESIDENT ARE THE RESULT OF SPONSOR OR PROMOTION PARTIES’ NEGLIGENT, FRAUDULENT OR RECKLESS ACT(S) OR INTENTIONAL MISCONDUCT.
8. RELEASE OF LIABILITY: By participating in the Sweepstakes, entrants agree (a) to release Sponsor, Promotion Parties, and each of their respective parent companies, subsidiaries, affiliates, officers, directors, employees, governors, owners, distributors, retailers, agents, assignees, advertising/promotion agencies, and representatives (collectively, the “Released Parties”), Instagram, Inc., and Meta, from any and all claims or actions of any kind whatsoever for injuries, damages or losses to persons and property, including bodily injury and death, arising from or relating to such entrant's participation or inability to participate in the Sweepstakes; (b) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs. By accepting a prize, each winner (a) agrees that the Released Parties will have no liability whatsoever for, and shall be held harmless by winner against, any liability for injuries, losses or damages of any kind to persons or property resulting in whole or in part, directly or indirectly, from participation in the Sweepstakes; from acceptance, possession, misuse or use of any prize, including travel thereto, and (b) grants (and agrees to confirm grant in writing promptly upon request) to Sponsor and its designees, and each of their respective designees the right to use his or her name, photograph, likeness, voice, image, statements, biographical information, at any time or times, for advertising, trade, publicity and promotional purposes in any media now known or hereafter discovered, worldwide, including the Internet without review, notification or approval, and additional compensation or consideration, unless prohibited by law. The Released Parties are not liable in the event that any portion of the Sweepstakes (including any prize) is compromised, modified or canceled due to pandemics or epidemics, outbreaks of infectious disease or any other public health crisis including quarantine measures of any government authority or other restrictions, weather, fire, strike, acts of war or terrorism, government restriction, or any other condition beyond their control (a “Force Majeure Event”).
9. DISPUTE RESOLUTION: The parties waive all rights to trial in any action or proceeding instituted in connection with these Official Rules, including, without limitation, the Sweepstakes. The parties each agree to finally settle all disputes only through arbitration; provided, however, the Sponsor shall be entitled to seek injunctive or equitable relief in the state and federal courts in the State of Texas, and any other court with jurisdiction over the parties. In arbitration, there is no judge or jury, and review is limited. The arbitrator’s decision and award is final and binding, with limited exceptions, and judgment on the award may be entered in any court with jurisdiction. The parties agree that, except as set forth above, any claim, suit, action or proceeding arising out of or relating to this Sweepstakes shall be resolved solely by binding arbitration before a sole arbitrator under the streamlined Arbitration Rules Procedures of JAMS Inc. (“JAMS”) or any successor to JAMS. In the event JAMS is unwilling or unable to set a hearing date within fourteen (14) days of the filing of a “Demand for Arbitration”, then either party can elect to have the arbitration administered by the American Arbitration Association (“AAA”) or any other mutually agreeable arbitration administration service. If an in-person hearing is required, then it will take place in the State of Texas. The federal or state law that applies to these Official Rules will also apply during the arbitration. Disputes will be arbitrated only on an individual basis and will not be consolidated with any other proceedings that involve any claims or controversy of another party, including any class actions; provided, however, if for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then the agreement to arbitrate doesn’t apply and the dispute must be brought in a court of competent jurisdiction in the State of Texas. Sponsor agrees to pay the administrative and arbitrator’s fees in order to conduct the arbitration (but specifically excluding any travel or other costs of entrant to attend the arbitration hearing). Either party may, notwithstanding this provision, bring qualifying claims in small claims court. This Sweepstakes is offered only in the United States and is governed by the laws of the state of Texas, and all claims must be resolved in the federal or state courts located in Collin or Dallas counties, Texas.
10. GENERAL CONDITIONS: The winners are solely responsible for any taxes on their prize, if any. The winners will be required to give their social security number to the Administrator as a condition of receiving the prize and will receive an IRS Form 1099 for the retail value of their prize. No cash equivalent or substitution of a non-cash prize is offered, except at the sole discretion of the Sponsor. Any difference between stated value and actual value will not be awarded. No transfer of a prize is permitted. Unclaimed prizes will not be awarded. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute a prize with another prize of equal or greater value. If for any reason the Sweepstakes is not capable of running as planned, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes or any other factors beyond Sponsor’s reasonable control, Sponsor and Administrator reserve the right, at their sole discretion, to (a) disqualify any individual who is responsible or who tampers with the operation of the Sweepstakes, and (b) cancel, modify or terminate the Sweepstakes. In the event of cancellation, Sponsor will randomly award the remaining prize(s) among all eligible, non-suspect entries received prior to cancellation. This Sweepstakes is offered only in the United States and all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Released Parties in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of State of Texas, without giving effect to any choice of law or conflict of law rules. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts for Collin or Dallas Counties, Texas.

In the event of any discrepancy between the Sponsor’s Privacy Policy and these Official Rules, these Official Rules shall control and govern. Additionally, any communication between entrant and Administrator, Sponsor or its agencies, regarding this Sweepstakes (e.g., phone calls, text messages, chats, emails, etc.), may be recorded for quality assurance and training purposes. Winners’ names will be included in a publicly available winner’s list.
11. MISCELLANEOUS: The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules or the Affidavit is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Official Rules or Affidavit will not constitute a waiver of that provision. Entrants agree to waive any rights to claim ambiguity of these Official Rules. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes-related materials, privacy policy or terms of use on any website, social media platform or application and/or the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control and the discrepancy will be resolved in Sponsor’s sole and absolute discretion.
LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE THE WEBSITE OR INTERFERE WITH THE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
